By purchasing a membership, buying single-entry tickets, or otherwise participating in a giveaway on this Site, you agree to be bound by the terms below. If you do not agree, do not use the Site or enter any promotion.
1. Definitions & Interpretation
1.1 “Site” refers to https://russoperformancegiveaways.com.au/ and any subpages, mobile applications, and associated platforms.
1.2 “Promoter”, “we”, “us”, “our” refers to Russo Performance Giveaways Pty Ltd.
1.3 “Member” means a person who purchases a subscription membership through the Site.
1.4 “Entry Purchase” or “Single-Entry Purchase” means a one-off purchase granting one or more entries into a specific giveaway.
1.5 “Giveaway”, “Promotion” or “Contest” refers to any prize draw or competition offered on the Site.
1.6 “Winner” means the person drawn in the random draw who meets all eligibility and verification requirements.
1.7 “Excluded States” refers to South Australia (SA) and Northern Territory (NT) and Australian Capital Territory (ACT), whose residents are not eligible to enter.
1.8 “Prize” refers to the item(s) offered through entries, including but not limited to vehicles, automotive parts, experiences, or other high-value items.
1.9 “Prize Value” refers to the retail value of the Prize as stated on the relevant giveaway page.
1.10 “Service” means the Site, membership platform, marketplace, and all information, content, features, and services provided through the Site.
1.11 “Account” means the user profile created during registration to access the Service.
1.12 “User Content” means all comments, feedback, suggestions, ideas, and other submissions disclosed, submitted, or offered by you in connection with your use of the Site or Service.
2. Eligibility
2.1 Entry is open to Australian residents only, except residents of SA and NT and ACT. Entries from SA and NT and ACT will be void.
2.2 Entrants must be 18 years or older.
2.3 By entering, you agree that any required ID, proof of age, and proof of residential address provided on request are genuine and accurate.
2.4 Employees, directors, officers, agents, and contractors of the Promoter (and their immediate family members and household members) are not eligible to enter or win any giveaway.
2.5 You represent that you have read and consent to our Privacy Policy in addition to these Terms and Conditions.
3. Entry Methods & Membership System
This promotion operates on a dual system: membership subscriptions and single-entry purchases.
3.1 Membership Subscriptions
Membership Tiers:
Ballers -$499.99 /month → [115] entries per monthly draw
Platinum – $249.99/month → [40] entries per monthly draw
Gold – $99.99/month → [12] entries per monthly draw
Sliver – $49.99/month → [4] entries per monthly draw
Bronze – $19.99/month → [1] entries per monthly draw
Membership Terms:
While your membership remains active and payment is successfully processed, entries are automatically added each billing cycle.
Memberships renew automatically every 30 days via a secure third-party payment processor (Stripe).
You may cancel at any time by logging into your member portal and following the cancellation process.
Cancelling stops future entries and further charges. Payments already processed are non-refundable.
All loyalty memberships are non-refundable. If a payment has recently been processed, it will not be eligible for a refund.
Payment Failure Protocol:
If your account fails to pay, there will be 4 automatic attempts made to bill your account.
The system will attempt to bill your account every 7 days (21-day grace period) from the initial payment failure.
On the 4th and final attempt, if payment is unsuccessful, your subscription will be terminated, and your loyalty streak will be lost.
Please note that the system allows for 4 attempts total, including any manual attempts made by you to charge the account.
Subscription Reactivation:
If you cancel your subscription, Stripe does not allow for its reactivation, and all accumulated history for that subscription will be lost.
To continue your subscription, follow the instructions in notification emails or log in to the member dashboard and update your banking details.
If your account is cancelled, you can sync up the last active entry history by creating a new subscription within 30 days of cancellation.
The system will sync up entry history as long as there is no gap greater than 30 days between a cancelled subscription and an active subscription.
3.2 One-Off Membership Packages
Customers may select a one-off package to access the platform and receive entries into giveaways.
One-off packages are non-refundable and purchased during promotional periods or giveaways.

3.3 Single-Entry Purchases
For non-members, or members who want extra entries beyond their subscription, single-entry purchases are available (e.g., Bronze, Silver, Gold packages).
Single-entry purchases are one-off transactions; entries are generated only upon successful payment.
Single-entry purchases are non-refundable unless the prize draw is cancelled or invalidated by the Promoter, in which case valid entries will be refunded in full.
3.4 Entry Recording
All entries (membership or single-entry) are recorded electronically and securely.
Entries cannot be exchanged, changed, or transferred to a different draw once purchased.
3.5 Restrictions on Use
Memberships and entries are personal and non-transferable and must not be used by syndicates, groups, or resold.
Sharing accounts or entries, or using multiple accounts to gain an unfair advantage, may result in immediate disqualification and account termination.
You may not share or transfer any Account or disclose your password to anyone.
4. Prize Draw Mechanics & Frequency
4.1 Giveaways are held multiple times per year. The frequency for each prize will be specified on the relevant entry page.
4.2 Draw Process:
All valid entries (membership entries + single-entry purchases) are pooled for each giveaway.
A computerised random electronic draw selects the winner.
The draw is conducted at the Promoter’s business address.
The winner is notified by phone and email within a specified timeframe (typically within 2 business days of the draw).
4.3 Winner Verification:
The winner must respond within 7 days of notification.
The winner must provide valid government-issued photo ID and proof of residential address to claim the prize.
If the winner does not respond within 7 days, or fails to provide required verification, an unclaimed prize draw will occur among the remaining valid entries.
4.4 Unclaimed Prize Draw:
If a prize remains unclaimed after the initial draw and notification period, a second draw will be conducted.
The Promoter will make reasonable efforts to contact the second-drawn winner.
If the prize remains unclaimed after the second draw, the Promoter reserves the right to retain the prize or conduct additional draws at its discretion.
5. Prizes & Prize Value
5.1 Prize values vary and will exceed AUD $10,000 for high-value items such as vehicles, automotive parts, or experiences.
5.2 The prize description on the entry page (including model, condition, accessories included, freight coverage, etc.) is final and reflects what can be won.
5.3 Freight & Delivery:
Freight for prize delivery in Australia is included unless stated otherwise on the giveaway page.
Delivery timeframes will be communicated to the winner upon verification.
The Promoter is not responsible for delays caused by freight carriers or circumstances beyond our control.
5.4 Installation & Additional Costs:
Unless otherwise stated, installation costs (e.g., for automotive parts or engines) are not included.
The winner is responsible for installation by a qualified professional.
Any modifications, registration, insurance, or ongoing costs associated with the prize are the winner’s responsibility.
5.5 Prize Substitution:
Prizes are not transferable or exchangeable and cannot be redeemed for cash.
The Promoter reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason.
6. Warranty, Condition & Liability for Prize Use
6.1 Warranty (if applicable):
For certain prizes that are new or refurbished goods (e.g., engine packages, automotive parts), a limited 12-month manufacturing-defect warranty may apply.
The warranty is void if the prize is misused, used for competition/racing, overboosted, overheated, improperly tuned, or installed incorrectly.
Warranty claims must be made directly to the manufacturer or supplier as specified in the prize documentation.
6.2 Condition & Inspection:
Prizes are provided in the condition described on the giveaway page.
Winners are encouraged to inspect the prize upon delivery and report any damage or defects within 7 days of receiving the item.
6.3 Limitation of Liability:
The Promoter takes no responsibility for any mechanical damage, installation faults, misuse, or any issues arising after delivery and/or installation.
By claiming the prize, you acknowledge and accept all liability for installation, use, and any consequences arising from the prize.
The Promoter is not liable for any injury, loss, or damage arising from the winner’s use or misuse of the prize.
7. Refunds, Returns & Entry Cancellation
7.1 Non-Refundable Payments:
Membership payments already processed are non-refundable, even if you cancel later.
Cancelling prevents future entries but does not retroactively refund past payments.
Single-entry purchases are non-refundable unless the prize draw is cancelled or invalidated by the Promoter.
7.2 Draw Cancellation:
If a prize draw is cancelled or invalidated by the Promoter, valid entries will be refunded in full.
The Promoter will notify affected entrants via email within 10 business days.
7.3 No Exchanges:
Entries cannot be exchanged, changed, or transferred to a different draw once purchased.
Refunds or rectifications for change of mind, misunderstanding, or selection of the wrong tier are not permitted.
7.4 Australian Consumer Law:
Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.
For major failures, you are entitled to cancel your service contract and receive a refund for the unused portion or compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods.
If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time.
8. Account Registration & Management
8.1 Account Creation:
To use certain portions of the Site and Service, you must register and create an Account.
As part of registration, you will provide your name, address, email address, phone number, and select a password.
You agree that all Registration Information will be true, accurate, current, and complete.
8.2 Account Security:
You must maintain the confidentiality of your password and Account.
You agree to immediately notify us at info@russoperformancegiveaways.com.au of any known or suspected unauthorised use of your Account or breach of security.
You are liable for all activities that occur under your Account, even if not committed by you.
8.3 Account Restrictions:
In creating an Account, you shall not:
Select or use the email address or username of another person with intent to impersonate
Use a name subject to the rights of any other person without authorisation
Use an email address or username that is profane, offensive, or otherwise inappropriate
Allow any other party to use your Account and/or password
8.4 Account Cancellation:
To cancel your account, log in to your web portal at https://russoperformancegiveaways.com.au/ and navigate to the membership section.
Click the designated cancellation button and follow the prompts to complete the process.
You will receive an email notification confirming cancellation.
Upon cancellation, you will be removed from all future payments and forfeited bonus accumulated entries from future promotional giveaways.
9. Termination of Account
9.1 You understand and agree that you have no ownership rights in your Account.
9.2 The Promoter may stop offering the Service at any time without notice or liability.
9.3 The Promoter may cancel your Account, delete all Registration Information and User Content associated with your Account at any time, without notice, for any reason or no reason, including your violation of these Terms and Conditions.
9.4 The Promoter will not be liable for any damages or loss resulting from the removal of any User Content from the Site and/or Service.
9.5 Upon termination, you must cease all use of the Site and Service.
10. Winner Privacy & Publicity
10.1 Winners’ names and state of residence may be publicly announced on the Site, social media, and other promotional channels.
10.2 Photos, videos, or more detailed personal information will only be published if the winner provides explicit written consent.
10.3 The Promoter will contact the winner and request permission prior to any public announcement of identifying information beyond name and state.
10.4 By entering, you consent to the Promoter using your name and state for promotional purposes if you are selected as a winner.
11. Privacy & Data Collection
By entering or using the Site, you consent to our Privacy Policy and to us collecting and using your personal data as follows:
11.1 What We Collect
Personal Information: Full name, email address, phone number, residential address, age/date of birth, ID verification details (for prize collection), payment status (via third-party processor)
Technical/Tracking Data: IP address, device information, cookies, website activity, pixel tracking data (for analytics and marketing)
Marketing Preferences: If you opt-in to receive email, SMS, and behavioural ad data
11.2 How We Use It
To process entries and manage giveaways
To verify eligibility and identity for winners
To contact winners and arrange prize delivery/logistics
To provide customer support
To operate, improve, and secure the Site and Services
To send marketing communications (email, SMS), including retargeting ads via platforms such as Meta, Google, and TikTok—only if you’ve consented
You may unsubscribe from marketing communications at any time using the unsubscribe links provided
11.3 Disclosure
We may share your data with:
Payment processors (e.g., Stripe, PayPal)
Freight carriers (for prize delivery)
IT service providers hosting or securing the Site
Marketing/advertising platforms (if you consented)
Marketplace partners (for product/service fulfilment)
Regulatory or legal authorities if required by law
We do not sell your information to third parties.
11.4 Storage & Security
We take reasonable steps to protect your data against unauthorised access, loss, misuse, alteration, or disclosure.
Data may be stored in Australia or overseas with secure cloud service providers.
We implement industry-standard security measures including encryption and secure servers.
